Penn Pfiffner, Chairman of the TABOR Committee, former legislator and founder of Construction Economics discusses The Taxpayer’s Bill of Rights (TABOR) provisions regarding the idea of imposing emergency taxes because of COVID-19. TABOR states that every government (state, local, special districts) must maintain a 3% set aside for emergency purposes only; emergency tax revenue is available only after the reserves has been depleted; the definition of an emergency excludes revenue shortfalls and; a bill allowing emergency taxes must pass by a supermajority of two-thirds in both the senate and the house. Unfortunately, since 2003 the legislators have not kept faith to the Colorado citizens as they have not been putting cash in reserves and are using buildings for reserves.
