Former candidate for Douglas County Sheriff John Anderson explains how we can constitutionally address dangerous individuals without harming due process. There are good intentions behind Colorado’s red flag law, but in execution, it’s a violation of 2nd amendment rights. The due process of the red flag law is extremely weak. We already have solutions that are more effective at addressing problems that the red flag law is meant to combat. M-1 holds are one such solution, which can restrict an individual’s actions if they’re deemed not mentally stable. M-1 holds aren’t perfect, but they do not egregiously violate the 2nd amendment.
